Terms and conditions for the use of the facilities provided by Go:ver Training Ltd.

INTRODUCTION

Please read our terms and conditions carefully. By partaking in activities at Go:ver Gym you are confirming that you have read the Terms and Conditions and agree to be bound by them.

The gym is operated by Go:ver Training Ltd. Registered office 52 New Town, Uckfield, East Sussex, TN22 5DE. Company Reg. No: 08957403.

Whether by joining the gym as a member, by attending the gym to use the facilities on a pay and play basis, by participating in classes held on the premises, or by attending personal training sessions, sports massage treatments or any other service at the gym, you are agreeing to accept, in full, all the following Terms and Conditions.

Go:ver Training Ltd. reserve the right to amend and/or revoke these terms and conditions at any time.

THE USE OF THE GYM AND FACILITIES

The gym’s normal opening hours are displayed in the reception area and are available on our website. The hours may be lengthened or shortened at the absolute discretion of Go:ver Training Ltd. Wherever possible, members will be provided with advance notice.

Go:ver Training Ltd cannot be held responsible for any services being unavailable due to reasons outside of our control.

The management reserves the right to refuse entry.

All members, non-members and customers agree to abide by the gym etiquette. These are displayed in the gym.

All belongings are left at the gym at the owner’s risk. Vehicles are parked in the gym’s car park at the owner’s risk. Go:ver Training Ltd. and the owners of Brockwells House cannot be held responsible for any loss or damage sustained to vehicles or their contents left in the carparks.

All facilities at the gym including but not limited to gym use, classes, and personal training and sports massage are used at the customer’s own risk.

BECOMING A MEMBER

Acceptance of membership is at the absolute discretion of Go:ver Training Ltd. who reserve the right to request proof of information supplied by prospective members.

Anyone wishing to use the gym (outside of our specialist grass roots membership) must be 16 or over, proof of I.D. may be required.

Details of memberships are available on our website along with the current list of fees.

Members will be required to fill in an online membership form, a direct debit form if applicable and agree to the terms and conditions/waiver regarding membership and use of the gym.

For members choosing a monthly membership the first payment will be a “starter payment” and all subsequent fees paid monthly in advance by direct debit.   The starter payment will be a fee calculated on a pro-rata basis in respect of the type of membership and the number of days between the date the membership is accepted and the date of the first direct debit. The starter payment is due immediately on signing the membership form and membership will not be processed until this is received. Any payment defaults will result in membership being suspended until full payment has been received.

Members choosing a 1 or 12 month membership will be required to pay the full amount for the agreed contract length prior to the membership being processed.

All membership fees are payable in full irrespective of amount of use of the gym and facilities.

Membership fees and benefits are subject to change at any time. Any changewill be displayed in the reception area prior to the commencement of change.

At the time of joining a photograph is taken as a means of identification. All membership information will be securely stored electronically.

Members must sign in at reception every time they wish to use the gym facility. Fraudulent use of a member’s sign in details will result in that member’s membership being cancelled and the member being suspended from using any of the gym facilities. There will be no refund of fees paid.

Members who do not know how to use the gym equipment safely must request a gym induction before first use of the gym.This induction session will introduce the member to the gym and to safe use of equipment. The member should not at any stage attempt to use equipment for which they have not received adequate instruction by a qualified member of staff.

Each member is personally responsible for using the gym equipment in a safe manner so as not to injure themselves or others.

CANCELLATION OF MEMBERSHIP

Memberships can be suspended under special circumstances at the management’s discretion.

If a member wishes to cancel their membership this must be detailed in writing by email to reception@govergym.co.uk giving a minimum of 1 months’ notice prior to the next direct debit payment.

If a member has decided to pay in full for 1 or 12 months, under normal circumstances membership cannot be cancelled during the term of the contract. At the end of the term the membership will expire if not renewed or replaced with a different type of membership.

Go:ver Training Ltd reserves the right to suspend or terminate a membership at any time without notice and with immediate effect if it is considered that the member’sconduct is detrimental to the interest of the company or to other persons using the gym, or if the member is in debt to Go:ver Training Ltd.

PAY AND PLAY USE OF THE FACILITIES

Non-members may use Go:ver Training Ltd facilities. The ‘pay and play’ rate for gym and class use must be paid before entering the gym area.

Non-members will be required to fill in an online client form and agree to the terms and conditions/waiver regarding use of the gym.

Non-members who do not know how to use the gym equipment safely must request a gym induction before first use of the gym. This induction session will introduce the member to the gym and to safe use of equipment. The non-member should not at any stage attempt to use equipment for which they do not feel confident using.

The non-member must always use gym equipment in a safe manner and behave appropriately.

CLASSES, PERSONAL TRAINING AND SPORTS MASSAGE

All classes are offered subject to availability.

Classes, personal training and sports massage must be booked in advance. Booking can take place at reception, by telephone or through the online booking facility.

Classes can be booked up to one week in advance for members and 1 day in advance for non-members. Numbers in classes are limited in accordance with our health and safety guidelines.

It is important to arrive on time for all bookings. Late arrival at personal training session or for a massage treatment will result in the session being shorter as it will still conclude at the prearranged time.

The pre session warm up in classes is designed to help with the avoidance of injury. The trainer has the right to refuse entry to a participant arriving more than 10 minutes late for a class. This is on the grounds of health and safety. Any fees paid for the class will not be refunded.

When cancelling or changing a booking at least 24 hours’ notice must be given. If the session has already been paid for and 24 hours’ notice has been given a full refund will be granted or the session transferred/re arranged for another time depending on availability. If less than 24 hours’ noticeis given and the booking has already been paid for, in normal circumstances no refund or transfer will be granted.If less than 24 hours’ notice is given and the session has not been paid for the member is liable for the full cost of the session.

If a member regularly cancels sessions they will lose the right to book in advance.

Go:ver Training Ltd reserve the right to cancel sessions. Where possible at least 24 hours’ notice of cancellation will be given.If the session has already been paid for the customeris entitled to a full refund. Alternatively the customer may transfer to another session depending on availability.

SAFETY ISSUES

Go:ver Training Ltd. takes the health and safety of all persons using their facilities very seriously. Staff members are trained in first aid.

Any medical condition(s) suffered by a member or non-member which could be exacerbated by exercise or which could affect that person whilst on the premises,must be made known to the gym staff. Any medications brought into the premises by a customer should be labelled and stored securely.

If it is felt necessary, a member or non-member may be asked to obtain written consent or written advice regarding exercise from their GP prior to anyparticipation in gym activity. The management reserves the right to refuse use of certain equipment or participation in certain classes if it is felt this could pose an unacceptable health risk to the member or non-member.

Using gym equipment incorrectly or using equipment on incorrect settings can be dangerous to both the user and to other people in the vicinity. If a member or non-member is in any doubt about how to use a piece of equipment then it is imperative that the advice of a Go:ver trainer is sought.

Members and non-members are required to comply with all reasonable requests made to them by the gym staff in matters of health and safety.

INFORMATION GOVERNANCE AND DATA PROTECTION

Go:ver Training Ltd. takes the protection of your personal information very seriously.

All records are retained on our secure computer system and staff are trained in the importance and maintenance of client confidentiality.

Membership information will only be used by Go:ver Training Ltd. and its employees in accordance with the Data Protection Act 1998.

By providing contact details the member/non-member is agreeing to receive communications via these methods.

Go:ver Training Ltd. should be informed as soon as practicable of any change of address, email, telephone or any other communication method.
